Were you aware of this commercial use to which your code is being put?

HyperChem Raytrace, together with POV-Ray (a freely available raytracing
package), provides facilities for producing high quality ray-traced
molecular images from HyperChem. HyperChem Raytrace uses DDE communication
with HyperChem to produce input *.POV files for POV-Ray. In order to use
HyperChem Raytrace to produce raytraced images, you must also install
POV-Ray, which is supplied with the distribution of ChemPlus."

At first glance it looked to be OK, but then I notice that instead of
saying POV-Ray is free, they say it's freely available.  Hmm...also left
out where to get it.

So I think you might have found something, but note that using POV-Ray
commercially is not against the rules.  It's selling it or using it to
sell another product without notifying people of it's free nature that
is.  This company isn't quite following the POV legal very closely it
would seem.

As I see it, they're selling their software and supplying POV-Ray with the
software, which suggests that they sell POV-Ray as part of the package.

That's what I took it as, so maybe they are in breach...  In which case.
SICK EM!!!  Just kidding, it's a hard one to decided, but I agree, it does
look like they're supplying it in a manner which would suggest it's part of
the package.

No, DDE is used to communicate between their two components, if I read it
correctly.  As I see it, there are two problems here; three if they didn't
obtain explicit permission from the POV-Team.

(1) The inclusion of POV-Ray should be promoted only as a free bonus and 
not as a feature designed to encourage customers to purchase or upgrade 
solely for the POV-Ray capability. 

(2)Include clear and obvious information on how to obtain the official 
POV-Ray. 

But this isn't really our problem.  Whoever posted the original message 
should bring it to the attention of Chris Young, including URLs and other
contact information if available, and then forget about it and let him
decide what to do with it.
