I don't think that's so funny, if he means it.. Not that I live in USA, but
this just can't be true.. I suppose you tried to optain a licence then? For
free?  We got GIF compression back at least. We will get your patch into
official POV-Ray as well.

I do not try to obtain any licence regarding any USA patents.
I'm just aware that such patents exist and are still valid.

Therefore, if you are relevant to USA laws, the patents applies to you.

Because the program is using technics that might be relevant
to the patents (I'm not the final judge on that, the court would be),
if you were using the program while also being subject to the USA patents,
you would be infringing the laws. 
This would means for you to be sent to jail, get a big fine or
whatever suit the texts, prosecutors and judges.

I do not want to be responsable for that, so I expressly forbid
the importation and/or usage of the program that I provide to 
any state of USA where you could get into trouble. Doing so, I just
try to introduce a limitation to my responsabilty so that when you
get prosecuted you could not turn too easily against me. You break
my recommendation/wording, so you assume that alone.

Recent history has proven that USA tend to apply USA laws to foreign
citizen for acts made outside of USA when the foreign citizen happen
to somehow pass on USA ground... so I'll also restrict my trip to
avoid USA ground.

As provided, the program was made in France, by French people, 
served by a French ISP, and is perfectly legal regarding french laws.

P.S.: there is no tricky code in the program to check where you are running it.

I think most people will agree such a patent is a bit crazy.. But probably
this has already been discussed in these newsgroups. Has anyone taken a
decision wether to contact the patent office in usa? Maybe there is an easy
solution to this. My experience equals zero but it couldn't hurt asking
them. Maybe it is just a formality.

  The cheapest solution is to not to put the program in a server in the USA.
  Whether an US citizen downloads and uses the program and whether that is
against the patent laws there is their headache. :)

Yes, but the patch won't become an official part of POV-Ray.. Would it even
be included in the next MegaPOV, users in the USA would break the law..
There has to be a disclaimer saying "MegaPOV is illegal" and the reputation
as legal freeware would suffer.

It could happen in Europe as well, for thanks to BSA initiative
European commission tries to give green light to software patents
in Europe. See http://petition.eurolinux.org
But I think that POV-Ray gets attention by lawyers only if it tries to 
compete with other commercial packages, as long it does not offer any
possibility to make money, it can vegetate...
