Usually "as of x date" means everything from that date forward. However
here they seem the mean everything up to that date. Perhaps it should be
made more explicit. 1.1 was released on August 16th.

So can I get this straight - It looks like I am going to have to use
megapov for my scene and I don't want to spend hours downloading it only to
find its banned:
Povray- all versions permitted
Megapov: all versions up to and including(datewise)megapov 1.0 permitted
Is this right?

Without a change in the rules to directly allow for MegaPov 1.1 Beta, that
appears to be the case.
Patched versions had to be publicly available on or before August 3rd.
MegaPov 1.1 Beta was announced on August 16th, making it clearly ineligible.
Bad timing, I suppose. I just hope everyone (else) realizes this.
