I thought the proof that it is a work of fiction is that there are no cars
blocking the intersection. :)

I might just be uber-picky but I noticed that too. It's one of the two 
things that IMO tell that it's not quite a photograph. That and the oddly 
circular glows from the headlights from the cars. But then again, it just 
looks like someone did a not-so-great Photoshop job! ;-)

One thing that is a dead give away is the street sign that says "S 403 ST"
We have no street here in New York that is numbered that high (not even in
Queens) With that view of the Chrysler Building the street number in the
40's looking south along Lexington Ave.
